Appeal Court Orders Police To Pay 5 Million Naira For Unlawful Detention



A court of Appeal sitting in Benin on Monday ruled that the Nigerian Police should within sixty days to pay the sum of five million Naira earlier granted by a lower court in Benin to one Mr David Ugolor over unlawful detention into interest yielding Bank account pending when the appeal is determined.

The ruling was consequent upon  a motion by the respondent’s counsel, Olayiwola Afolabi demanding the money be paid from the appeal with registration number CA/B/360/12.

Giving the ruling, the presiding Judge, Justice Hellen Ogunwumiju compelled the appellant to pay the five million naira to the Deputy Chief Registrar of the court within sixty days from the ruling after which the money will be paid into an interest yielding Bank account pending when the appeal case is determined and later awarded to the winner of the case.

Nosakhare Uwadiae who observed the Court procedures reports that the court also struck out a motion by the appellant requesting the court to stay  execution or further execution which was supported with a five paragraph affidavit in the motion dated 3rd April, 2013.
